Yes, Texans Can Buy Cannabis in New Mexico
Any adult 21 or older with a valid government-issued photo ID can purchase recreational cannabis at any licensed New Mexico dispensary. There are no residency requirements. A Texas driver's license works. You have the same purchase limits as NM residents: up to 2 ounces of flower, 16 grams of extract, and 800mg of edibles per transaction.
If you have an out-of-state medical cannabis card, New Mexico recognizes it. Medical patients are exempt from the state excise tax, which can save you 13% on your purchase.
Texas Cannabis Penalties

A single cannabis vape cartridge purchased legally in New Mexico becomes a state jail felony in Texas. Texas classifies all cannabis concentrates — including vape oil, wax, shatter, and distillate — as a felony regardless of the amount. There is no misdemeanor threshold for concentrates in Texas.

The NM-TX border has developed a concentrated dispensary industry specifically serving Texas visitors:

Why You Can't Bring It Back
Even if New Mexico and Texas both legalized cannabis, transporting cannabis across state lines would still be a federal offense. The Controlled Substances Act makes interstate transportation of cannabis a federal crime. Add the fact that Texas has some of the harshest cannabis penalties in the country, and the risk calculation is straightforward:
- Crossing the state line with cannabis = Texas criminal charge + potential federal charge
- Texas border-county law enforcement is aware of the dispensary traffic and patrols accordingly
- Drug dogs are used at federal checkpoints in southern NM (see our checkpoint guide)
- A felony conviction in Texas affects employment, housing, gun rights, and voting rights
The Smart Approach
The legal way to enjoy New Mexico's cannabis market as a Texas visitor:
- Plan a trip. Stay overnight in NM. Enjoy the dispensaries, food, art, and landscape.
- Consume everything in NM. Do not bring products back across the state line.
- Pay cash or use a debit card. Most NM dispensaries are cash-preferred, though many have ATMs and some accept debit.
- Keep receipts. While they won't protect you at a federal checkpoint, they document legal purchase within NM.
