New Mexico Cannabis Possession Limits

Two ounces of flower in public, no limit at home — New Mexico has one of the most generous possession frameworks in the country. Same limits for residents and visitors.

Recreational Possession (Adults 21+)

Under the Cannabis Regulation Act (NMSA 1978 §26-2C), adults 21 and older may possess the following amounts in public:

No Limit at Home

One of New Mexico's most distinctive features: there is no possession limit at your residence. Adults 21+ may store any amount of cannabis in their home. This is unusually permissive — most states impose the same limits at home as in public. New Mexico's approach recognizes that home growers may accumulate product from their legal harvests.

Same Rules for Everyone

New Mexico does not distinguish between residents and out-of-state visitors. Purchase and possession limits are identical regardless of where you live. You just need a valid government-issued ID showing you are 21+.

Medical Patient Possession

Patients registered under the Lynn & Erin Compassionate Use Act have separate, more generous limits:

  • Purchase limit: Up to 15 ounces per 90-day period (approximately 425 grams).
  • No public carry distinction: Medical patients may carry their adequate supply as documented by their provider.
  • Home cultivation: Medical patients have the same 12-plant per person limit as recreational users.

Purchase Limits

While the possession limits above define what you can carry, individual purchase transactions are also governed by CCD regulations. Dispensaries track purchases through the state's seed-to-sale system (BioTrack). The daily purchase limit aligns with the public possession limit — 2 oz flower, 16g concentrate, or 800mg edibles per transaction.

What About Equivalency?

New Mexico uses product-type-specific limits rather than a single THC-equivalency formula. You may legally carry 2 oz flower and 16g concentrate and 800mg edibles simultaneously, as each category has its own independent limit. This is more permissive than states that use a combined equivalency calculation.

Exceeding Limits Is Still a Crime

Possessing more than 2 oz but less than 8 oz of flower in public is a misdemeanor carrying up to 364 days in jail and a $1,000 fine. Over 8 oz is a felony. Stay within the limits.

Gifting

Adults 21+ may gift up to the public possession limit (2 oz flower, 16g concentrate, 800mg edibles) to another adult 21+ — as long as no money or other compensation changes hands. This mirrors the gifting provisions common in other legalization states.
