Possession Penalties for Adults 21+
Under the Cannabis Regulation Act and New Mexico's criminal code, penalties escalate sharply once you exceed the legal limits:

Underage Possession (Under 21)

Distribution and Sale Penalties
Unlicensed distribution carries significantly harsher penalties than personal possession:

Home Cultivation Penalties
Adults 21+ may grow up to 12 plants (6 mature). Exceeding the plant count carries penalties:
- 12+ plants over the limit: Felony (4th degree) — up to 18 months prison, $5,000 fine.
- Growing without proper enclosure: Plants must be in a locked, enclosed space out of public view. Violations may result in fines and plant seizure.
Public Consumption
Consuming cannabis in a public place (outside of a licensed consumption lounge) is a $50 civil fine. This is not a criminal offense — it is treated like a parking ticket. However, repeat violations in certain locations (near schools, government buildings) may result in escalated enforcement.
School Zone Violations
Cannabis possession, use, or distribution within 300 feet of a school carries enhanced penalties. Distribution near a school can elevate a charge by one felony degree.
Federal Checkpoint Risks
While not a state penalty, it's critical to understand: Border Patrol operates federal interior checkpoints on I-25 and I-10 in southern New Mexico. Cannabis found at these checkpoints falls under federal jurisdiction, where it remains a Schedule I controlled substance regardless of New Mexico state law.
